These Terms of Service apply when you visit saltysurf.co.nz or purchase products from Salty Surf & Co.

Throughout these Terms, “we”, “us” and “our” refer to Salty Surf & Co. By accessing our website or placing an order, you agree to these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms limits or excludes your rights under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable New Zealand law.

Our online store is hosted by Shopify, which provides the ecommerce platform we use to sell our products.

WEBSITE USE

You may use our website only for lawful personal and non-commercial purposes.

PRODUCT INFORMATION

We make every reasonable effort to ensure our product descriptions, photographs, sizing information, colours and prices are accurate.

Colours and product appearance may vary slightly depending on your screen, device settings, garment production and the nature of the printing process. Small variations that do not affect the overall quality or intended appearance of a product are not necessarily considered faults.

Garment measurements may have normal manufacturing tolerances. Please review the relevant product description and size guide before ordering.

Nothing in this section affects your rights if a product is faulty, materially different from its description or does not meet the guarantees required by New Zealand consumer law.

AVAILABILITY

All products are subject to availability.

We may limit the quantity of a product available for purchase or discontinue a product at any time. If an ordered item becomes unavailable after you have placed your order, we will contact you and offer an alternative, a refund or another suitable solution.

ORDERS

When you place an order, you are offering to purchase the selected products under these Terms.

You are responsible for checking that your order details, product selections, sizes, delivery address and contact information are correct before completing your purchase.

After placing an order, you will receive an order confirmation at the email address you provided. We may contact you if we need to confirm or clarify any part of your order.

We reserve the right to decline or cancel an order where:

• A product is unavailable

• Pricing or product information contains an obvious error

• Payment cannot be authorised

• We reasonably suspect fraud or unauthorised activity

• We cannot deliver to the address provided

• The order breaches these Terms

If we cancel an order after payment has been received, we will provide a full refund using the original payment method.

PRICES AND PAYMENT

Unless stated otherwise, all prices displayed on our website are in New Zealand dollars.

Shipping costs and any other applicable charges will be shown at checkout before you complete your purchase.

We may change prices, shipping charges, promotions or discounts at any time. Changes will not affect orders that have already been accepted, except where there has been an obvious pricing error.

Payment must be successfully completed using one of the payment methods available at checkout.

PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions, including expiry dates, minimum purchase amounts and product exclusions.

Unless stated otherwise:

• Only one discount code may be used per order

• Discount codes cannot be exchanged for cash

• Discounts cannot be applied retrospectively

• Promotions are available only while stocks last

We may withdraw or correct a promotion where there has been an error, misuse or circumstances outside our reasonable control.

SHIPPING AND DELIVERY

Orders are shipped in accordance with our Shipping Policy.

Any delivery time shown on our website is an estimate. We will make reasonable efforts to dispatch orders promptly and keep customers informed of significant delays.

Where we arrange delivery, Salty Surf & Co. remains responsible for ensuring the order is delivered within a reasonable time and arrives in acceptable condition, as required by New Zealand consumer law.

Please contact us at saltysurf@xtra.co.nz if your parcel is significantly delayed, lost or arrives damaged.

You are responsible for providing a complete and accurate delivery address. Additional delivery costs resulting from an incorrect or incomplete address may be charged to you where permitted by law.

RETURNS, EXCHANGES AND REFUNDS

Change-of-mind returns, exchanges and refunds are handled according to our Refund Policy.

If a product is faulty, damaged, incorrectly supplied, not fit for purpose or does not match its description, you may be entitled to a repair, replacement, refund or another remedy under the Consumer Guarantees Act 1993.

The conditions applying to change-of-mind returns do not limit your rights in relation to faulty or incorrectly supplied products.

CANCELLATIONS AND ORDER CHANGES

If you need to change or cancel an order, please contact us as soon as possible at saltysurf@xtra.co.nz.

We will try to accommodate your request, but we cannot guarantee that an order can be changed or cancelled after processing or dispatch has begun.

INTELLECTUAL PROPERTY

The content on this website, including our original artwork, garment graphics, photographs, written content, branding, layout and product designs, is owned by Salty Surf & Co. or used with the permission of the relevant owner.

You may view and use the website for your own personal and non-commercial purposes.

You must not copy, reproduce, modify, distribute, sell, manufacture from, publish or commercially use our content or designs without prior written permission.

References to third-party names or brands remain the property of their respective owners.

CUSTOMER REVIEWS AND CONTENT

If you submit a product review, photograph, comment or other content to us, you confirm that:

• The content is honest and based on your own experience

• You have the right to provide and share it

• It does not infringe another person’s rights

• It is not unlawful, misleading, abusive or offensive

You give Salty Surf & Co. permission to display and use content you submit in connection with our website, products and marketing. We will not sell your personal photographs or content as standalone products without your permission.

We may remove content that is unlawful, misleading, offensive, irrelevant or in breach of these Terms.

These Terms and any dispute relating to our website or products are governed by the laws of New Zealand.
